Barber Ford Used Car Guarantees

DETAILS AND LIMITATIONS

All Barber "Ford Used Car Guarantees" are subject to the following terms, limitations, and conditions:

1. The Cancellation Option requires the payment of a fee based on the vehicle sales price ranging from $75-$400. In order to qualify for the "Two Day Two Hundred and Fifty Mile Money Back Guarantee", the vehicle must be returned in substantially the same condition in which it was purchased within forty-eight (48) hours and with no more than two hundred fifty (250) additional miles on the odometer. The vehicle must be free of all liens and encumbrances, other than any lien or encumbrance created by or incident to the conditional sales contract, any loan arranged by us, or any purchase money loan obtained by the buyer from a third party. All keys, manuals and accessories must be in substantially the same condition and working order as when it was delivered. Once the mileage limitation has passed or is exceeded or the cancellation deadline has passed, the cancellation option is void. Barber Ford will rescind the transaction for any vehicle returned pursuant to the "Barber Ford Money Back Guarantee" and refund all amounts paid by the customer for the purchase of said vehicle less the maximum allowable restocking and cleaning fee. The restocking and cleaning fee will be reduced by the amount you were charged for the cancellation option. Any used vehicle trade-in received as part of the original transaction, will be returned to Customer. In the event Customer's used vehicle trade-in has been sold and is unavailable for return to Customer, Barber Ford shall refund and pay to said Customer, in lieu of returning the used vehicle trade-in, the amount reflected in the Purchase Contract as the net trade-in value. If Barber Ford inadvertently pays off the prior credit or lease balance on the trade-in before you exercise the option to cancel the purchase, you agree to reimburse the pay off amount to us at the time you exercise the option; we may collect this amount by offsetting it against the full refund and by other legal means. The restocking and cleaning fee has been set by California Law as follows: 1) $5000 or less $175; 2) $5000>$10,000 $350; 3) $10,000 > $500.
   
   
2. Barber Ford's "Clean Title Guarantee" is limited specifically to items that would be reflected in a CARFAX Vehicle History Report (the "Report") that would constitute "Branded Title". "Branded Title" is a passenger motor vehicle ownership or registration document issued by any of the 50 states of the U.S. (or the District of Columbia) or a passenger motor vehicle registration document issued by any province of Canada which was issued with words or symbols signifying that the vehicle was: junked or salvaged; dismantled, rebuilt or reconstructed; flood damaged; fire damaged; hail damaged; bought back by its manufacturer ("Lemon Law" vehicle); odometer exceeds mechanical limits; odometer was not actual mileage; declared a total loss (Canada only); or which was issued with any other symbol or word signifying a similar Brand. The Branded Title must have been issued by a motor vehicle agency from which CARFAX receives and loads data about Branded Titles. Barber Ford agrees to pay to a Customer who substantiates a written claim that a used vehicle he/she purchased from Barber Ford has a "Branded Title", an amount equal to the full Retail Kelley Blue Book value of the purchased vehicle on the date the written claim is made reduced by an amount equal to the reasonable rental and/or usage value of the vehicle during Customer's ownership. Barber Ford's "Clean Title Guarantee" is limited to one (1) year following the date of purchase.
